1. Acceptance of Terms

By accessing or using ChatLingo (the "Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, you may not use the Service. These Terms apply to all visitors, users, and others who access the Service.

2. Eligibility

You must be at least 13 years old to use the Service. By using the Service, you represent and warrant that you meet this requirement. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

3. Account Registration

To access certain features, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@chatlingo.app if you suspect unauthorized use of your account.

4. Subscriptions and Payments

  • Free Plan: Certain features are available at no cost, subject to usage limits described in the Service.
  • Pro Plan: Premium features are available through a paid subscription billed monthly or annually.
  • Billing: By subscribing, you authorize us to charge your payment method on a recurring basis. All fees are in USD and are non-refundable except as required by law or as stated herein.
  • Free Trials: If we offer a free trial, your subscription will automatically convert to a paid plan at the end of the trial period unless you cancel beforehand.
  • Cancellation: You may cancel your subscription at any time through your account settings or by contacting support. Cancellation takes effect at the end of the current billing period.
  • Price Changes: We reserve the right to change subscription prices with at least 30 days' notice.

5. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable local, national, or international law or regulation
  • Transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity
  • Attempt to gain unauthorized access to any part of the Service or its related systems
  • Use automated scripts, bots, or other means to access the Service in a manner that exceeds normal human usage
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use the Service for any commercial purpose without our express written consent

6. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of ChatLingo and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

You retain ownership of any content you submit to the Service. By submitting content, you grant ChatLingo a non-exclusive, worldwide, royalty-free license to use, reproduce, and process your content solely for the purpose of providing and improving the Service.

7. AI-Generated Content

The Service uses artificial intelligence to generate conversational responses and feedback. AI-generated content is provided for educational and practice purposes only. We do not guarantee the accuracy, completeness, or appropriateness of AI-generated content. You should not rely on AI-generated content as a substitute for professional language instruction in critical contexts.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CHATLINGO AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to defend, indemnify, and hold harmless ChatLingo and its licensees, employees, contractors, agents, officers, and directors from and against any claims, damages, obligations, losses, liabilities, costs, or expenses arising from your use of the Service or your violation of these Terms.

11. Termination

We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the Service will immediately cease.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in San Francisco County, California.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after any changes constitutes your acceptance of the new Terms.
